General Terms and Conditions (GTC)
1 Scope of application
a) These GTC apply to all services provided by the Psycura Practice, including psychological and medical psychotherapy, counseling, diagnostic assessments and drug treatments.
b) The GTC govern the contractual relationship between the Psycura Practice and clients (natural and legal persons) who make use of personal, telephone or digital services.
2. Services offered
The Psycura Practice offers fee-based services in the field of psychological and medical diagnostics, psychotherapy and counseling. By using a service, clients agree to these GTC.
3. Place of service
Unless otherwise agreed, the services take place in the practice rooms of Praxis Psycura (Hofwiesenstrasse 349, 8050 Zurich).
4. Conclusion of contract
a) A contract is concluded when the Psycura Practice and the client agree on an appointment for diagnostics, treatment or counseling. This can be done verbally or by means of a written treatment agreement.
b) The Psycura practice may refuse requests without giving reasons, e.g. if the treatment does not fall within its area of expertise or if there is no capacity available.
5. Content of the treatment contract
a) The Psycura Practice makes its expertise available and adheres to the highest ethical and scientific standards in order to support clients in their growth and healing process in the best possible way.
b) Treatment planning is carried out together with the client, whereby Psycura's recommendations are non-binding. Clients inform the Psycura Practice of any relevant concerns, changes or requests.
c) In the event of a crisis (e.g. acute suicidal tendencies), clients undertake to contact the Psycura Practice or a crisis intervention center immediately.
d) The Psycura Practice accepts no liability for the consequences of decisions made by clients during treatment.
e) Clients are obliged to provide relevant information (e.g. symptoms, illnesses). In the event of incomplete information, the Psycura Practice reserves the right to terminate the treatment.
6. Fees
The Psycura practice is entitled to compensation for all services rendered.
Psychological and medical psychotherapy is covered by basic insurance in Switzerland (less "Franchise" and "Selbstbehalt") if it serves to recognize or cure an illness, prevent its worsening or alleviate symptoms.
The fees include, in particular, session time, preparation and follow-up time, internal intervision for quality assurance, as well as administrative services connected to the treatment. The processing of the registration and appointment scheduling becomes chargeable from the moment an appointment offer is made.
Services provided in the absence of clients are likewise fully chargeable. This includes, in particular, the processing of emails, which is billed in the same way as a telephone or other remote consultation, based on the time required, as well as telephone or video-based consultations, the preparation of reports, certificates or statements, and any other professional activities carried out in connection with the treatment.
The fees in effect at the time of the treatment or appointment agreement apply, or the remuneration agreed upon individually between the Psycura practice and the clients within the framework of a treatment agreement or package.
7. Cancellations and No-Show Policy
a) Clients receive a confirmation by text message when making or changing an appointment and a reminder by text message a few days before the appointment.
b) Scheduled appointments and treatment agreements are binding. Last-minute cancellations by clients will be fully charged:
- for initial consultations if the cancellation is made less than 48 hours before the appointment,
- for all other appointments if the cancellation is made less than 24 hours before the appointment.
The deadlines refer to working days (Monday to Friday, excluding public holidays).
Example:
If an appointment takes place on Monday at 10:00 a.m., a cancellation
- in the case of an initial consultation must be made no later than the preceding Thursday at 10:00 a.m.,
- for all other appointments no later than the preceding Friday at 10:00 a.m.,
so that no costs are incurred.
c) Group Appointments: If clients cannot attend a scheduled group session, the agreed fee for group participation is still due, and clients are not entitled to compensation or reimbursement.
d) If Praxis Psycura cannot provide a service, no fee will be charged. However, it is not liable for any resulting expenses (e.g., travel costs).
e) Neither Praxis Psycura nor clients can expect guaranteed outcomes from the treatment.
f) Treatment can be discontinued at any time. Clients will pay for services already rendered. If Praxis Psycura discontinues treatment, fees for unrendered sessions will be waived.
g) If a session is shortened due to a client’s behavior or decision (e.g., lateness or client-requested early end), clients are still responsible for the full session fee.
8. Confidentiality
a) Praxis Psycura treats all client information confidentially and discloses it only with explicit consent or when legally required.
b) In cases of acute self-harm or risk to others, Praxis Psycura is legally obliged to take protective measures, including organizing a protective intervention and notifying guardians in the case of minors.
c) Clients in group events commit to maintaining confidentiality regarding information about other participants.
9. Data protection (DSG) and consent to unencrypted email communication
Personal and health-related data is processed in accordance with the provisions of the Swiss Data Protection Act (DSG).
If clients or other contact persons contact the practice via an unencrypted or unsecured email address and transmit personal or health-related data in the process, this is deemed to constitute consent to unencrypted electronic communication. The sender is aware that email correspondence without special security measures entails risks with regard to confidentiality and data protection. The practice is entitled to reply in the same form by email. The responsibility for choosing this form of communication lies with the sender. For the transmission of particularly sensitive personal data, the practice recommends the use of a secure communication channel such as HIN.
10. Services from Third-Party Providers
Praxis Psycura assumes no liability for the referral to and services of third-party providers.
11. Disputes Disagreements
Disputes Disagreements should be resolved amicably whenever possible. Written complaints should be directed to the respective contracting party.
12. Changes
Praxis Psycura may change the T&C at any time. Changes will be communicated to clients in writing at least one month in advance.
13. Severability Clause
Should any provision of these T&C be invalid, the remaining provisions remain unaffected.
14. Governing Law and Jurisdiction
Only Swiss law applies. The place of jurisdiction is Zurich.
